1. Acceptance of Terms
By accessing or using the Quotcha AU website and services (the "Services"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Services.
"Quotcha", "we", "us", and "our" refer to Quotcha AU and its operators. "You" refers to any individual or entity accessing the Services, whether as a homeowner, contractor, or visitor.
2. Description of Services
Quotcha provides:
- Quote Analysis: AI-powered analysis of trade quotes uploaded by homeowners, including pricing benchmarks, compliance checks, and suggested questions.
- Comparison Quotes: A matching service that connects homeowners with licensed contractors who may offer competitive pricing for the same scope of work.
- Contractor Platform: A registration and lead distribution system for licensed tradespeople.
3. Introduction Service Only — No Contracting Relationship
Quotcha is an introduction platform only. We connect homeowners with contractors. We are not a party to, and accept no liability for, any contract, agreement, or arrangement made between a homeowner and a contractor.
Any agreement for the performance of trade works is solely between the homeowner and the contractor. Quotcha does not:
- Guarantee, warrant, or endorse the quality, timeliness, or outcome of any work performed by a contractor.
- Supervise, manage, direct, or control any trade works.
- Act as an agent, employer, or partner of any contractor.
- Provide trade, building, financial, or legal advice.
You acknowledge that any reliance on a contractor introduced through Quotcha is at your own risk. We strongly recommend that you independently verify a contractor's licence, insurance, and references before engaging them.
4. AI Analysis — Informational Only
Our AI-powered quote analysis is provided for informational purposes only and does not constitute professional advice of any kind — including trade, building, financial, legal, or consumer advice.
While we strive for accuracy, AI-generated analysis may contain errors, omissions, or inaccuracies. Pricing benchmarks are based on aggregated historical data and may not reflect current market conditions in your specific area.
You should not rely solely on Quotcha's analysis when making decisions about accepting, rejecting, or negotiating a trade quote. Always obtain independent professional advice where appropriate.
5. Your Obligations
All users agree to:
- Provide accurate and truthful information.
- Not upload fraudulent, misleading, or illegal content.
- Not use the Services for any unlawful purpose.
- Not attempt to reverse-engineer, scrape, or misuse the platform.
Contractors additionally agree to:
- Hold and maintain all licences, permits, and insurance required by law for their trade and jurisdiction.
- Provide accurate business details, ABN, licence number, and insurance documentation.
- Respond to leads in a timely and professional manner.
- Pay applicable lead fees as agreed upon accepting a lead.
- Contact homeowners within 24 hours of receiving their details after payment.
- Not circumvent the platform to avoid lead fees (e.g., soliciting homeowner details through other channels after receiving a lead notification).
6. Estimates, Approvals & Payments
Quotcha may generate estimates on behalf of contractors based on the scope of work and agreed pricing. These estimates are proposals only and do not constitute a binding contract until both parties independently agree to terms.
Homeowner approval of an estimate via our platform indicates interest in proceeding. It does not create a contract with Quotcha — any resulting contract is between the homeowner and the contractor directly.
Contractor lead fees are non-refundable once homeowner contact details have been provided, except where required by Australian Consumer Law. Lead fees are for the introduction only and do not guarantee that the homeowner will proceed with the work.
7. Limitation of Liability
To the maximum extent permitted by law, Quotcha excludes all liability for:
- The quality, safety, legality, or outcome of any trade works performed by a contractor.
- Any loss, damage, injury, or expense arising from or in connection with work performed by a contractor introduced through Quotcha.
- The accuracy, completeness, or reliability of AI-generated analysis, pricing benchmarks, or any other information provided through the Services.
- Any disputes between homeowners and contractors.
- Unauthorised access to or loss of your data, to the extent permitted by law.
- Service interruptions, downtime, or technical errors.
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law, including the consumer guarantees under the Competition and Consumer Act 2010 (Cth).
8. Indemnity
You agree to indemnify and hold harmless Quotcha, its officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Services.
- Any breach of these Terms by you.
- Any contract or dispute between you and another user (homeowner or contractor).
- Any content or documents you upload to the platform.
9. Intellectual Property
All content, branding, software, AI models, and materials on the Quotcha platform are owned by or licensed to Quotcha and are protected by Australian and international intellectual property laws.
You retain ownership of any documents you upload. By uploading content, you grant Quotcha a non-exclusive, royalty-free licence to process, analyse, and store that content for the purpose of providing and improving the Services, including generating aggregated, de-identified benchmark data.
10. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
11. Suspension & Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms or engaged in conduct that is harmful to other users, contractors, or Quotcha.
Contractors may have their accounts suspended or terminated for providing false licence or insurance details, failing to pay lead fees, or engaging in unprofessional conduct.
12. Dispute Resolution
Any dispute arising from or relating to these Terms or the Services shall first be addressed through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution through the relevant Australian court or tribunal.
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via our website. The "Last updated" date at the top indicates when the Terms were most recently revised. Continued use of the Services after changes constitutes acceptance.
